{"id":142,"date":"2012-03-10T21:43:24","date_gmt":"2012-03-10T18:43:24","guid":{"rendered":"http:\/\/lawlorkiernan.ie\/?p=142"},"modified":"2020-10-06T18:37:46","modified_gmt":"2020-10-06T15:37:46","slug":"irish-times-march-10-2012","status":"publish","type":"post","link":"https:\/\/lawlorkiernan.ie\/de\/irish-times-march-10-2012\/","title":{"rendered":"Irish Times \u2013 March 10, 2012"},"content":{"rendered":"<h2>\u20ac15,000 Award Against Insurer<\/h2>\n<h6><em>Saturday, March 10, 2012<\/em><\/h6>\n<p>Michael Collins had asked the court to assess compensation against FBD Insurance, which had earlier been found by the Data Protection Commissioner to have breached the Data Protection Acts.<\/p>\n<p>It was the first time the Circuit Court had been asked to assess damages in the area of data protection law.<\/p>\n<p>The commissioner had held that FBD failed to provide full documentation to Mr Collins, a member of the Traveller community, relating to a claim he made about a stolen work van.<\/p>\n<p>FBD had refused to pay out on the claim because Mr Collins allegedly failed to disclose a previous criminal conviction on his policy proposal form.<\/p>\n<p>Barrister Andrew Robinson said Mr Collins, of Mellowes Park, Finglas, Dublin, had challenged FBD\u2019s contention that the proposal form contained any inquiry relating to criminal convictions.
