Lawlor Kiernan LLP is a progressive legal and tax firm offering specialist advice. The practice was founded as Lawlor Partners in 1995 and has established a reputation for the provision of high quality legal and tax services.

Partner

Niall is a partner with Lawlor Kiernan LLP. He specialises in litigation with a particular focus on representing clients in tracker mortgage overcharging cases.

His other areas of practice include contractual disputes, clinical negligence, probate litigation and personal and fatal injury cases.

Recent cases and legal work include:

Supreme Court
● Appointed under the Supreme Court Legal Assistance Scheme to represent the appellant in Cave Projects Limited -v- PG, JK, JM, ROB and JOH.

Tracker Mortgage Litigation
● Represented customers in over two hundred cases against Irish banks with the combined settlements exceeding 10 million euro.

● Represented a customer in the largest settlement paid by AIB in a tracker mortgage case.

Commercial Litigation
● Represented a food supplier in Commercial Court breach of contract proceedings. Negotiated a substantial settlement for the food supplier (PS t/a PS & Company v Tesco Ireland Limited).

● Represented a construction company in defending a High Court injunction regarding claims of mismanagement of company funds and shareholder oppression.

Clinical Negligence
● Represented clients in a wide range of clinical negligence actions against public and private hospitals.

● Represented a client who was left in a persistent vegetative state due to an undiagnosed stroke, in which a significant settlement was obtained.

Fatal Injury and Injuries at Work
● Represented the family of a deceased man in the Coroner’s Court who was killed following a HGV tyre exploding and obtained a significant settlement in respect of their High Court damages claim.

● Represented a client who lost multiple fingers while working in a meat factory and obtained a significant settlement in the High Court.

● Represented a client who suffered catastrophic burn injuries at work due to an explosion following a gas leak and obtained a significant settlement in the High Court.

Probate
● Succeeded in having an executor removed and the appointment of an independent administrator in the first decision of its kind in Ireland (In the Matter of The Estate of Mary Ann (Otherwise Maureen) Horan).

● Represented a party in a dispute that arose following the murder of a young Croatian man. The dispute centred on which parent was entitled to take custody of the deceased’s body (In the Matter of Josip Strok, Deceased)

Olivia works in the Property Department, with extensive and wide-ranging experience in all aspects of commercial and business law. Olivia specialises in commercial and residential property transactions. She acts for various corporate and private clients in relation to the acquisition, funding and disposals of property. She also advises both landlords and tenants of commercial property in the negotiation of new leases and the assignment and subletting of existing leases.

Olivia has a comprehensive understanding of the complex legal and business issues associated with both commercial and residential property transactions.

Olivia also practices in the area of will drafting, probate, estate planning and administration of estates.

AnnMarie has over 11 years’ experience in the areas of Litigation, Probate, Wardship, Conveyancing and Wills and Estate Planning. AnnMarie is a graduate of the University of Limerick and qualified as a Solicitor in 2012.

AnnMarie has completed the Society of Trusts and Estate Planning Diploma (STEP) and the Certificate in Assisted Decision Making and Capacity. AnnMarie is representing clients in relation to all arrangements under the newly established Decision Support Service (DSS).

AnnMarie also deals with all Probate related matters, both contentious and non-contentions. She guides Executors/Administrators through the probate process in a sensitive and efficient manner. AnnMarie also assists clients in relation to taxation issues arising.

Maeve graduated from UCD with a Bachelor of Business and Law. After working in the banking industry for a few years she went on to qualify as a Solicitor in 2007 with Carney McCarthy Solicitors. She then practised in Dun Laoghaire in A McCann & Co Solicitors (formerly McCann Morrissey Clarke).

During her career Maeve has gained broad experience and knowledge in a variety of private client areas, with emphasis on Probate and Wills, including Will Trusts, Conveyancing (private and commercial), Probate Litigation, Commercial Leasing and General Litigation.

Have completed the Law Society Certificate in the Assisted Decision-Making Capacity Act, 2105 in 2023, Maeve now regularly appears before the Circuit Court seeking Decision-Making Representative Order or acting as Independent Solicitor for Relevant Persons, as well as High Court applications seeking the dismissal from Wardship on behalf of Wards and/or their Committee.

Maeve joined Lawlor Kiernan in September 2024 and has undertaken the Diploma in Trust and Estate Planning with the Law Society and is currently an affiliate member of the Society of Trust and Estate Practitioners. This will further enhance her ability to advise clients in relation to appropriate tax planning for inheritance purposes as well as general wealth tax planning.

Maeve is a member of the Free Legal Advice Centres (FLAC). A voluntary organisation which gives guidance to those who are not in a position to afford formal legal advice.

Cathal Lawlor established the tax division within Lawlor Partners in 2006. This division provides advice on a wide range of tax issues including Income Tax, Capital Gains Tax, Capital Acquisitions Tax and Stamp Duty.

Cathal has expertise in advising on property transactions, family partnerships, transfer of assets to the next generation, tax efficient remuneration and Revenue investigations.

An alumnus of both Deloitte and Mazars where he gained valuable experience across a range of tax heads, he specialised in private client taxation with a particular interest in Estates and probates. He qualified as a Chartered Tax Adviser from the Institute of Tax in 1999. He augmented that qualification in 2013 when he became a member of the Society of Trust and Estate Practitioners an international professional body for advisers who specialise in inheritance and succession planning. This enables Cathal to give clear and accurate tax advises to other legal firms and accountancy practices and clients generally which require the input of an experienced tax specialist.

He has presented to several professional accounting bodies for CPD purposes, business forums and Chambers of Commerce and has contributed to a variety of national publications on Tax matters.
