Practice areas How can we help? Data Protection Rights

If you believe that your personal information has been inappropriately used or stored and your data protection rights have been breached we offer the following services:

  1. First Consultation/phonecall free: Call us to arrange a consultation or discuss your potential case on the phone. We will advise you if you have a stateable case under the Data Protection Acts. We will offer you advise as to whether a breach of your rights has taken place and whether you may be entitled to some form of redress.
  2. Data Subject Access Request: Pursuant to Section 3 of the Data Protection Acts you have a right to find out if a company/organisation holds information about you. We will draft a Data Subject Access Request to take up your personal information/data from the company/organisation who retains it.
  3. The Data Protection Commissioner: Where applicable we will refer the matter to the Office of the Data Protection Commissioner. The Commissioner will investigate the alleged breach and make a finding.
  4. Settlement/Court Proceedings: Based on the finding of the Commissioner we will draft and issue proceedings. It is worth noting that 90% of data protection cases settle outside of court. See our case studies for examples of cases we have settled.
