PODRUCJE DJELOVANJA Hand and Finger Injuries

Hand and Finger injuries are some of the most common injuries people experience in the workplace, particularly in factories or manufacturing plants.

Compensation can vary depending on the extent of the injury; the worse the injury the higher the compensation. If the injured party is unable to return to work due to the injury, there may also be a significant loss of earnings claim into the future.

Here are some examples of hand and finger injury caseswhere we have represented clients:

Case Study 1 – Injury at Meat Processing Plant

We represented a man who operated a bandsaw in a boning hall in a meat processing factory. Our client sustained significant injuries when the saw he was operating cut the top of his thumb and his index finger off.

After we were instructed in the case, we immediately wrote to the meat factory and called upon them to preserve the area and machine involved in the incident to enable our engineer to carry out an immediate inspection. Following our initial letters, the meat factory admitted liability in the case.

We obtained reports from a specialist hand plastic surgeon that performed surgery on our client. We also obtained reports from experts outlining our client’s loss of earnings into the future as he was unable to return to that type of work. We also obtained psychiatric reports outlining the impact the incident had on our client’s mental health.

We subsequently settled the case for a significant amount of compensation for our client’s hand injury and his future loss of earnings.

Case Study 2 – Hand Injury at Insulation Factory

Our client worked for an insulation company and was in the process of cutting insulation products when he cut off the top of his left middle figure and the top of his ring finger. He underwent emergency surgery and a significant programme of rehabilitation.

We obtained an engineer’s report outlining the lack of safety measures/safety equipment in place. We then issued proceedings against our client’s employer for negligence.

On the hearing date, the case settled for a significant sum of compensation together with legal costs.

Case Study 3 – Injury at Food Processing Plant

We acted on behalf of a female client who worked at a food processing plant. Her job was to slice sauce packets so that could be individually packed. In the course of cutting the sauce packets, she cut off the top of her left index finger.

As a result of this incident, our client required emergency surgery, ongoing rehabilitation and suffered significant nerve damage to her index finger. Our client also suffered from depression as a result of the injury and was prescribed anti-depressant medication.

We obtained a plastic surgeon and an engineer’s report and issued High Court proceedings against our client’s employer for failing to have the correct safety measures and safety equipment in place. We also claimed that our client’s employer was negligent for not having any training in place for their staff to carry out this type of work.

Shortly after we issued personal injury law proceedings, the Defendant contactedusand we settled this case for a significant amount of compensation and our legal costs were paid.
